This blog is a personal passion project dedicated to exploring the intersection of artificial intelligence and human creativity in music, including providing AI-powered mastering, editing, and stem separation tools. By accessing or using this site (including its services), you agree to be bound by these Terms of Use.

1. Nature of the Content

· AI-Generated Music (Site Content):
All musical compositions, instrumentals, and soundscapes featured as content on the blog are generated using artificial intelligence tools. As per current interpretations of copyright law in many jurisdictions, AI-generated works may not be eligible for traditional copyright protection.

· Human-Created Lyrics (Site Content):
All lyrics, poems, and textual content accompanying the AI music featured as content on the blog are created by humans and are considered the intellectual property of their creators (as credited or specified on the blog).

· Experimental & Non-Commercial (Site Content):
The blog and all its featured content are created strictly for fun, entertainment, experimentation, and personal enjoyment. It is NOT a commercial venture. No featured content is sold, and the blog generates no revenue from this content.

2. ITS. Vermeer Music AI Mastering Studio, Editing/Mixing Studio & STEM Separator Tool (The "Services")

This section governs your use of the AI Mastering Studio, Editing/Mixing Studio, and STEM Separator Tool offered on ITS. Vermeer Music.

· 2.1 User-Uploaded Content:

o You retain full ownership and all intellectual property rights to any audio files, stems, or musical works ("Your Content") that you upload to the Services for processing.

o You represent and warrant that:
 § You own or have the necessary rights, licenses, and permissions to upload and process Your Content through the Services.
 § Your Content does not infringe upon the intellectual property rights, privacy rights, or any other rights of any third party.
 § Your Content does not contain illegal, defamatory, obscene, or otherwise harmful material.

o ITS. Vermeer Music reserves the right to refuse to process any Your Content at its sole discretion, particularly if it violates these Terms or is deemed inappropriate.

· 2.2 Grant of License by You:

o By uploading Your Content to the Services, you grant ITS. Vermeer Music a worldwide, non-exclusive, royalty-free, limited license solely for the purpose of:
 § Operating, providing, and improving the Services (including AI processing, storage necessary during processing, and delivering the processed output to you).
 § Performing technical functions such as transcoding, analysis, and generating the processed output.

o This license does NOT permit ITS. Vermeer Music to:
 § Sell, license, sublicense, publicly perform, publicly display, or distribute Your Content or the processed output except as strictly required to provide the Service to you.
 § Use Your Content or the processed output for marketing or promotional purposes without your explicit permission.
 § Retain copies of Your Content or the processed output beyond what is reasonably necessary for the operation of the Service and legal compliance (e.g., brief caching, backup systems). We aim to delete source files and processed outputs promptly after delivery.

· 2.3 Processed Output:

o The audio file generated by the Services ("Processed Output") is a derivative work based on Your Content and processed using ITS. Vermeer Music's AI tools and algorithms.

o Ownership: Subject to the underlying rights in Your Content and the tools used, you own the Processed Output created specifically for you from Your Content.

o Usage Rights: You are granted a worldwide, non-exclusive, royalty-free license to use, copy, modify, distribute, publicly perform, and publicly display the Processed Output for any lawful purpose, including commercial use (e.g., releasing songs, monetizing streams/videos). This right is subject to Section 3.4 (No Commercial Use of ITS.Vermeer Music Tools/Content).

· 2.4 Prohibited Use of Services:

You may not use the Services:
 § To process content you do not own or have rights to.
 § For any illegal purpose or to generate illegal content.
 § To attempt to reverse engineer, decompile, or discover the source code of the AI tools.
 § In a way that overloads or disrupts the Services.

· 2.5 STEM Separator Tool:

o The STEM Separator Tool allows users to upload audio files and extract separate instrumental and vocal tracks (stems) using AI processing.

o Usage & Rights:
 - You retain ownership of both the original audio file and the resulting separated stems.
 - You are free to use the stems for any lawful purpose, including remixing, educational use, or commercial production, subject to any underlying rights in the original file.

o Processing Notice:
 - The separation process uses automated AI algorithms and may not always yield perfect results, especially with complex audio mixes.
 - Audio quality and clarity of separation may vary depending on file quality and musical complexity.

o Responsibility:
 - By using the STEM Separator Tool, you confirm that you either own or have the legal rights to the audio content submitted.
 - ITS. Vermeer Music is not responsible for misuse of the tool or any resulting legal claims related to user-uploaded material.

o License to Operate the Service:
 - You grant ITS. Vermeer Music a temporary, limited license to process and temporarily store your file and resulting stems solely for the purpose of providing the STEM separation service.
 - All source and output files are deleted after processing and delivery, except for brief temporary caching or legal compliance.

3. Intellectual Property & Your Rights

· 3.1 AI Music (Site Content):
You are welcome to listen to, share links to, and enjoy the AI-generated music featured as content on the blog freely for personal, non-commercial use only.

· 3.2 Human Lyrics (Site Content):
The human-written lyrics featured as content on the blog are protected by copyright. You may read and share links to them for personal enjoyment. Reproduction, distribution, modification, or public performance of these lyrics outside of this blog context requires explicit written permission from the credited lyricist.

· 3.3 Blog Content (Text, Images, etc.):
All written descriptions, blog posts, and original images created by the blog author and featured as content on the blog are protected by copyright. You may share links but may not reproduce substantial portions without permission.

· 3.4 No Commercial Use of ITS.Vermeer Music Tools/Content:
You MAY NOT use the ITS.Vermeer Music AI Mastering Studio, Editing/Mixing Studio tools, STEM Separator Tool, or any pre-existing AI-generated music, human lyrics, blog text, or images featured as content on the ITS.Vermeer Music blog (collectively, "ITS.Vermeer Music Tools/Content") for any commercial purpose whatsoever. This includes, but is not limited to:
 § Selling, licensing, or offering access to the ITS.Vermeer Music Tools/Content.
 § Using ITS.Vermeer Music Tools/Content in advertisements, promotions, or commercial products.
 § Monetizing ITS.Vermeer Music Tools/Content on other platforms (e.g., YouTube, Spotify, social media ads).
 § Using ITS.Vermeer Music Tools/Content as background music for commercial streams, videos, or podcasts.
 § Repurposing ITS.Vermeer Music Tools/Content for commercial AI training datasets without explicit written permission.

Exception: Your ownership and commercial rights to the Processed Output created by the Services from Your Content are governed by Section 2.3 and are explicitly excluded from this prohibition.

4. User Responsibilities

· Respectful Interaction:
Comments and discussions are encouraged but must be respectful, on-topic, and free of spam, hate speech, harassment, or illegal content.

· No Scraping/Bulk Downloading:
Do not use automated tools (bots, scrapers) to download or extract large amounts of content from this site.

· Attribution:
If sharing small excerpts (e.g., quoting a line of lyrics from Site Content in a review or discussion), please provide clear attribution and a link back to the original post on ITS. Vermeer Music.

· Compliance with Service Terms:
When using the Services (AI Mastering/Editing/STEM Separation), you agree to comply with Sections 2.1 (warranties for Your Content) and 2.4 (Prohibited Use).

5. Disclaimer of Warranties & Liability

· "As Is":
This blog, all its featured Site Content, and the Services are provided "as is" and "as available" for your personal enjoyment or use. We make no warranties regarding the accuracy, completeness, reliability, or suitability of the content or services. The AI music (both site content and processed output) is experimental. The AI Mastering, Editing/Mixing, and STEM Separator Services are provided using automated tools and may produce unexpected or imperfect results. They are not a substitute for professional human audio engineering.

· No Liability:
To the fullest extent permitted by law, the operators and creators of ITS. Vermeer Music disclaim all liability for any direct, indirect, incidental, consequential, or special damages arising from your access to, use of, or inability to use the blog, its content, or the Services, or any errors or omissions therein. This includes, without limitation, any liability arising from:
 (a) your use of any Site Content;
 (b) your use of or reliance on the Services or any Processed Output;
 (c) any loss or corruption of Your Content uploaded to the Services;
 (d) any inability to access or use the Services.

6. AI Specifics

· Origin:
AI music featured as Site Content is generated using various publicly available AI tools and platforms. Specific tools used may be mentioned in individual posts but are subject to change.

· AI Mastering/Editing/STEM Tools:
The AI Mastering Studio, Editing/Mixing Studio, and STEM Separator utilize proprietary and/or third-party AI tools and algorithms. The specific tools and techniques used are part of the service operation and may change without notice.

· No Endorsement:
Mention of any specific AI tool or platform does not constitute an endorsement.

· Inherent Limitations:
We acknowledge the ongoing debates and complexities surrounding AI-generated content, including copyright, ethics, and originality. This blog and the Services are an exploration within this evolving landscape. This includes limitations inherent in AI-assisted audio processing. Results are generated algorithmically and may not reflect subjective human judgment or meet professional standards in all cases.

7. Changes to Terms

We reserve the right to update or modify these Terms of Use at any time. The "Last Updated" date at the top will reflect changes. Your continued use of the blog or the Services after changes constitutes acceptance of the revised Terms.

Any disputes arising directly or indirectly from these Terms or your use of the site or the Services shall be subject to the exclusive jurisdiction of the courts located within the Philippines.
